Custody: Legal Versus Physical

In Massachusetts, courts determine child custody disputes based upon the best interests of the child, rather than the interests of either parent. There are two different types of child custody in Massachusetts:

  • Physical custody refers to the parent with whom the child primarily resides.
  • Legal custody refers to decision-making power regarding the medical care, education and religious upbringing of the child.

It is possible to arrange a custody plan that involves any combination of physical and legal custody. For example, parents often share joint legal custody, while one parent is awarded sole physical custody and the other is given significant "parenting time" (formerly known as visitation).
